Terms of Service

Welcome and thank you for your interest in LeadContact, including related websites, networks, applications and other services we offer (collectively, the "Services"). These terms of the Services are legally binding contracts between you and LeadContact regarding your use of the Services. Please read these terms carefully. By clicking "Accept" or by downloading, installing or otherwise accessing or using the Services, you agree that you have read and understood, and as a condition of your use of the Services, you agree to be bound by and subject to the following terms, including LeadContact's Privacy Policy (collectively, the "Terms"). If you do not meet the conditions, or do not agree to the terms, then you do not have our permission to use the Services. LeadContact provides Web-based tools to manage and automate workflows, as well as multiple platforms and services with customers and prospects.

Qualification

You must be at least 18 years of age to use the Service. By agreeing to these terms, you represent and warrant to us that (a) you are at least 18 years of age; (b) You have not previously been suspended or removed from the Service; (c) Your registration and use of the Services comply with any and all applicable laws, as well as regulations. If you are an entity, organization or company, the individuals who accept these terms on your behalf represent and warrant that they have the right to bind you to these terms and that you agree to be bound by these terms.

Account and registration

To access most of the features of the service, you must register an account. When you register for an account, you may be required to provide us with some information about yourself, such as your name, email address, or other contact information. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. When you register, you will be asked to authenticate through LinkedIn. You are solely responsible for maintaining the confidentiality of your LinkedIn account and password, and you accept responsibility for all activities that occur under your LinkedIn CRM and LinkedIn accounts. If you believe that your account is no longer secure then you must notify us immediately by sending an email to hello@leadcontact.ai.

Third party service

Third party services and LinkedIn

LeadContact use LinkedIn cookies to enhance your use within the LinkedIn ecosystem, such as summarizing user information, finding emails, and to provide you with a personalized experience. LeadContact may provide tools through services that enable you to interact with and export information to: third-party services, including allowing you to link your account on LeadContact with your account on third-party services. You are solely responsible for maintaining your account with such third parties in good standing and in compliance with any applicable third party terms of Service and laws for the services. By using one of these tools, you authorize LeadContact to act as your agent and on your behalf, or through third party services, and you agree that LeadContact may transfer information to or from third party services on behalf of third party services applicable to you, And execute command directions at your location or through such services. Third party services are not under the control of LeadContact, and to the fullest extent permitted by law, LeadContact is not responsible for any third party service's use of your exported information. The service may also contain links to third party websites. Linked sites are not under the control of LeadContact and LeadContact is not responsible for their content.

If you need to synchronize LinkedIn information to Google Sheets, we will require your authorization to grant Google Sheets permissions for:

• Creating: Dedicated spreadsheets for synced LinkedIn data.
• Viewing: To verify sync accuracy.
• Modifying: To keep data current with LinkedIn updates.
• Deleting: To secure user privacy on request.

LeadContact use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Third-party software

The Service may include or incorporate third-party software components that are generally available free of charge for licensing fees that grant recipients broad rights to copy, modify, and distribute those components (" Third Party Components "). Although the Service is provided to you under these Terms, nothing in these Terms prevents, restricts or is intended to prevent or limit your use of third-party components under applicable third-party licenses or limits your use under such third-party licenses.

General Payment Terms

LeadContact is operated by WILLING TECH PTE. LTD (hereinafter referred to as the “Company”, “we”, or “us”).
Certain features of the Services may require payment of fees. Before you pay any fees, you will be given the opportunity to review and confirm the applicable charges. Unless otherwise expressly stated in these Terms or the Refund Policy, all fees are denominated in U.S. dollars (USD).
Depending on the payment method you choose at checkout, payments will be processed by Paddle.com or Stripe.

Pricing

LeadContact reserves the right to determine and adjust the pricing of its Services at its sole discretion, and will make reasonable efforts to ensure that pricing information displayed on the website is accurate and up to date. We recommend that you regularly review our website for the latest pricing information.
LeadContact may modify its fee structure, including introducing new fees or changing existing charges, with prior notice. LeadContact may also, from time to time, offer promotional pricing or special offers with different features or conditions to some or all users. Unless you are expressly notified of such an offer, these promotions do not apply to you.

Refund Policy

We offer a 14-day refund window starting from the date of purchase.
Refunds are available within 14 days of purchase for eligible purchases.

• Payments made via Paddle will be refunded directly by Paddle in accordance with Paddle's refund policy. LeadContact does not process refunds for Paddle orders.
• Payments made via Stripe will be refunded by WILLING TECH PTE. LTD in accordance with this Refund Policy and applicable consumer protection laws.

Payment Authorization

You authorize LeadContact (or, depending on your chosen payment method, Paddle or Stripe) to charge all applicable fees for your orders and selected service plans, including any applicable taxes, to the payment method you have provided, in accordance with these Terms and related pages.
If you pay by credit card, the payment service provider may perform a pre-authorization before the transaction to verify the validity of your card and the availability of sufficient funds.

Subscription Services

Certain Services may be offered on an automatically recurring subscription basis (“Subscription Services”). By activating a Subscription Service, you authorize us to automatically charge the applicable subscription fees and taxes at the beginning of each billing cycle, at the then-current rates.
Your subscription billing date is the date on which you first purchase the Subscription Service. Unless you cancel your subscription before the renewal date, your subscription will automatically renew and continue in effect.
You may cancel your subscription at any time prior to renewal via our website or by contacting us at: hello@leadcontact.ai.
Cancelling a subscription will prevent future billing cycles but does not automatically entitle you to a refund, unless otherwise provided in the Refund Policy or required by applicable law.

Overdue Accounts

If your account has any overdue or unpaid amounts, LeadContact reserves the right to suspend or terminate your access to all or part of the Services without further notice until such amounts are fully paid.

Fair Use Policy

Certain subscription plans offered by LeadContact may be described as providing “unlimited” queries. This term is based on reasonable and normal commercial usage and does not mean unlimited, unrestricted, or abusive use.
To ensure service quality and prevent abuse (including but not limited to bulk abuse, account sharing, or automated access), each account is subject to a Fair Use Policy limit of 20,000 queries per month. We monitor usage and reserve the right to impose restrictions or take appropriate measures in cases of abnormal or abusive usage.

Ownership

The service is owned and operated by LeadContact. Visual interfaces, graphics, designs, compilations, information, data, computer code (including source code or object code), products, software, services, and other elements of all services offered by LeadContact (" Materials ") are protected by intellectual property and other laws. All materials included in the Service are the property licensors of LeadContact or its third parties. You may not use these materials unless expressly authorized by LeadContact. LeadContact reserves all rights to the material not expressly granted in these Terms.

User content

Grant a limited license to LeadContact

By providing User Content to or through the Services, you grant LeadContact a worldwide, non-exclusive, royalty-free, fully paid right and license (with sublicensable rights), To host, store, transfer, display, perform, copy, modify to format to display and distribute your User Content or portions in any media format and through any media channel now known or later developed.

User Content representations and warranties

LeadContact disclaims any and all liability in connection with user content. You are solely responsible for your User Content and the consequences of providing User Content through the Services. By providing User Content through the Service, you acknowledge, represent and warrant that:

1. You are the creator and owner of User Content, or have the necessary licenses, rights, consents, and permissions to grant LeadContact and Service users the right to use and distribute your User Content, the numbers, services, and these terms necessary to exercise the license you grant in this section in the manner contemplated by LeadContact;
2. Your User Content, and the use of your User Content in accordance with these Terms, does not and will not:
   1. infringe, violate, or misappropriate any third party rights, including any copyright, trademark, patent, trade secret, moral, privacy, image, or any other intellectual property, or proprietary rights;
   2. defamation, libel, slander or violation of the rights of any other person to privacy, image or other property rights;
   3. cause LeadContact to violate any law or regulation;
3. Your User Content may not be deemed by a reasonable person to be offensive, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate.

User Content Disclaimer

We have no obligation to edit or control User Content posted or posted by you or other users, and are not responsible or liable in any way for User Content. However, LeadContact may, at any time and without prior notice, filter, remove, edit or block us in our sole discretion from violating these terms or otherwise objectionable. You understand that in using the Services, you will be exposed to user content from a variety of sources and acknowledge that User Content may be inaccurate, objectionable, indecent or objectionable. You agree to waive and do waive any legal or equitable rights or remedies you have or may have with respect to the User Content figures. If the user or the content owner notifies the user that the content allegedly does not comply with these terms, we may investigate the allegation and, in our sole discretion, remove the User Content, and we reserve the right to remove the User Content at any time without notice. For the sake of clarity, LeadContact does not allow copyright infringement activities on the service.

Monitoring content

1. LeadContact does not control and does not assume any obligation to monitor:
   1. User content;
   2. Any content is provided by third parties;
   3. The use of the Services by its users.

You acknowledge and agree that LeadContact reserves the right and may from time to time monitor any and all information transmitted or received through the Services for operational and other purposes. If at any time LeadContact chooses to monitor content, LeadContact shall not be liable or liable for the content or any damages. Damage caused by the use of the content. During the monitoring period, information may be reviewed, recorded, copied and used in accordance with our Privacy Policy.

Prohibited act

By using the Service, you agree not to:

1. Use the Services for any unlawful purpose or in violation of any local, state, national, or international law, including without limitation laws relating to spam or unsolicited communications;
2. harass, threaten, belittle, embarrass or otherwise harm any other user of the Services;
3. infringe or encourage others to infringe any right of a third party, including the infringement or misappropriation of any intellectual property rights of a third party;
4. interfere with security-related features of the Services, including: (i) disabling or circumventing features that block or restrict the use or reproduction of any content; Or (ii) reverse engineer or otherwise attempt to discover the source code of any part of the Service, except as expressly permitted by applicable law;
5. interfere with the operation of the Services or any user's enjoyment of the Services, including:
   1. uploading or otherwise disseminating any virus, adware, spyware, worm or other malicious code;
   2. Make any unsolicited offers or advertisements to other users of the Service or any third party Service;
   3. Collecting personal information of other users or third parties without their consent;
   4. Interfere with or disrupt any network, device or server connected to or used to provide the Services.
6. Engage in any fraudulent activity, including impersonating any person or entity, claiming a false affiliation, or accessing any other service account without permission;
7. Sell or otherwise transfer any access rights (as defined in this Agreement) granted under these Terms or any Material or any right or ability to view, access or use any Material;
8. Attempt to engage in any of the acts described in this Agreement, or assist or permit any person to engage in any of the acts described in this Agreement.

Term, termination and modification of the Service

Terminology

These Terms end upon your acceptance of the Terms or your first download, installation, access or use of the Services and upon termination.

Terminate

If you violate any provision of these Terms, your authorization to access the Services and these Terms automatically terminates. In addition, LeadContact may, in its sole discretion, terminate these Terms or your account, or suspend or terminate your access to the Services, at any time for any reason or no reason, with or without notice. Effect of termination

Upon termination of these Terms: (a) Your license rights will terminate and you must immediately stop using the Services; (b) You will no longer be authorized to access your account or Services; (c) You must pay LeadContact to digitize any unpaid amounts due prior to termination (d) All payment obligations accrued prior to termination and the rest of this Agreement are described.

Service modification

LeadContact reserves the right to modify or discontinue the Service at any time (including by limiting or temporarily or permanently discontinuing certain features of the Service) without notice. Any changes or discontinuance of the Services or any suspension or termination of your access to or use of the Services.

Privacy policy

Please read the LeadContact Digital Privacy Policy carefully to learn about our collection, use, storage and disclosure of your personal information. The LeadContact Digital Privacy Policy incorporates these Terms by incorporation by reference and becomes part of these Terms.

Additional clause

Your use of the Services is subject to all additional terms, policies, rules or guidelines that apply to the Services or certain features of the Services that we may post on or link to on the Services (" Additional Terms "). All additional terms are incorporated into and become part of these Terms by this reference.

Consent electronic communication

By using the Service, you consent to receive certain electronic communications from us, as defined in our Privacy Policy. Please read our Privacy Policy to learn more about our electronic communications practices. You agree that any notice, agreement, disclosure or other communication that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

Nonsupport

We are not obligated to support the service. To the extent that we may provide support, it will be subject to published policies.
