Living Trusts provide all the benefits of a "will" in that you are able to direct who will receive your assets. However, living trusts are much more powerful that wills because they offer the privacy of probate avoidance, seamless asset transfers, and asset protection for gifts you think may be in jeopardy of loss to a beneficiaries creditors (or future law suits such as a judgment of divorce). Often when people ask to have an irrevocable trust drafted, what they really want is a revocable living trust that becomes irrevocable upon their death. When an irrevocable trust is actually the correctly desired legal tool is a scenario where the person creating the trust wishes to make a present irrevocable transfer of control over an asset or assets, in order to preserve wealth, and/or to qualify for a governmental benefit.

Estate planning attorneys use revocable living trusts to transfer assets outside of court supervision. A benefit to having a revocable living trust, is that it is entirely revocable while the trust creator is alive. In the event of a situation where you would want to dissolve a revocable living trust (such as a divorce), you would only have to re-title bank accounts and other assets such that they are no longer owned in the name of the trust.
