Ying Xia

As a member of PM's Construction Advisory & Disputes Team, Ying assists with pre-action claims, adjudication, international arbitration arising from construction, energy and infrastructure projects, with a focus on those under the Belt and Road Initiative.

- Involved in international arbitration and cross-border litigation matters in relation to disputes that arise from, i.e., ship construction contracts, ship purchase and sale contracts, sale of goods contracts, charterparties, marine insurance policy, shipping-related financial instruments, etc; - Involved in multiple UK Commercial Court proceedings including, inter alia, application for anti-suit injunction, strike-out application, application for summary judgment, etc; helped prepare for the Case Management Conference before English court.

- Assisted HKIAC Counsels with arbitration case administration, including management of case files, preparation of Appointment Committee agendas, Procedural Committee Agendas, First Letters, correspondences to parties and arbitrators, etc - Supported Deputy Secretary-General’s role as a Tribunal Secretary in a construction dispute involving Chinese disputants, helped draft procedural sections of the arbitral award, organised the case file for the Arbitral Tribunal - Translated and proofread final and partial arbitral awards, correspondences to parties, HKIAC news and press release, practice notes, regulatory policies, etc - Helped coordinate industrial and social events, including ADR-related seminars and conferences

- Drafted legal documents (i.e. Affidavits, Statement of Claims, Subpoenas, Chronologies, etc) for Supreme and District Court litigation proceedings regarding construction, corporate and commercial disputes - Conducted legal research, drafted legal advice to client on litigation intricacies with respect to further security for costs, statutory trust for sale of property, judicial sale of property, etc - Drafted correspondences (i.e. Calderbank Letters) to the other side, reviewed and provided primary legal advice on commercial agreements - Engaged in the preparation for the court hearing (i.e. List of Authorities, Court books, etc), liaised with clients and witnesses, conducted minor research tasks for the barrister, etc - Translated and proofread correspondences, legal advice letters, legal disclaimers, etc

- Assisted with civil and criminal litigation proceedings, helped prepare briefs to barristers, reviewed and organised court documents and materials from clients - Drafted and proofread correspondences and legal documentation, including legal memorandums, contracts, etc - Assisted as a Mandarin Interpreter in client interviews and negotiations, translated instructions and documents given by Chinese-speaking clients - Other general tasks including managing case files, writing meeting minutes, liaising with governmental and regulatory bodies, etc

- Assisted ACICA associates with the administration of arbitration cases, provided case summaries and helped manage trust accounts - Assisted ACICA Rules Committee in revising the arbitral rules relating to arbitration costs and third-party funding - Summarised and edited the latest news in the ADR area, undertook legal research and contributed articles to the Australian Dispute Centre Bulletin

• Undertook legal research and presented findings and opinions to Partners and Associates with respect to ambiguities under UK and PRC maritime law, which concern Subrogation Right, General Average Adjustment, and Limitation of Liability of Marine Salvors • Participated in due diligence by examining contracts and framework agreements as well as reporting on and summarising unfavourable terms • Supported the drafting of legal memorandums by researching, analysing and comparing different arbitration rules of arbitral institutions in different jurisdictions • Recorded billable hours, helped draft emails, translated and edited firm brochure for business development

• Proofread due diligence reports, legal memorandums, and case closure reports • Undertook legal research and provided preliminary legal opinions on the application of corporate law • Prepared translation of multiple maritime and commercial legal documentations, including Co-reinsurance Agreements, Determination of Liability for Marine Traffic Accident, Cargo Damage Report and so forth • Recorded billable hours and assisted in the preparation of seminars given by Partners

• Worked with the Anti-Trust Law and Data-Protection workgroup • Conducted legal research on regulations of data protection in multiple foreign jurisdictions and provided legal opinions to Partners and Associates • Translated, edited and published vital news in the legal field on the self-media platform

• Liaised with shippers and terminal agencies for confirmation of goods status and delivery • Managed Shipping Freight and Issuance of Bills of Lading for each shipment, Arranged Customs Declaration for each voyage on the line through AMS • Accommodated special shipment requirements or conditions in cooperating with Sales and Equipment teams, confirmed customer payment and invoices with Finance team • Followed up and Updated the movement of the ships and goods on the line, Assisted foreign branches in discharging ports with issues concerning shippers or delivery of goods
