SEASONED EMPLOYMENT TRIAL LAWYER I regularly represent employers facing claims and threats from their current or former employees. These claims include discrimination, harassment, wage and hour and class actions. I help employers quickly identify the issues they are facing as well as how to achieve the best outcomes. Additionally, when former employers steal trade secrets or new hires potentially bring competitors trade secrets, I advise employers how to best deal with these threats. My approach to litigation matches each client’s budget, tolerance and overall needs. In short, we do what we need to do to get the desired outcome. I have litigated hundreds of matters in state and federal courts and arbitrations. FORMER ASSISTANT U.S. ATTORNEY I spent almost five years working in the Civil Division of one of the largest U.S. Attorney’s Office in the country. I handled all aspects of defending the United States and its agencies and employees. This experience has given me a tremendous insight into how cases typically progress to resolution and how judges and juries are most likely to respond to the facts of the case. I had a good track record of winning cases on motions, at trial and, if necessary, on appeal. LOCAL AND NATIONAL BAR LEADER I feel it is important to give back to my legal community. In addition to my pro bono work, I was president of the Beverly Hills Bar Association – a full-service bar representing over 6,000 lawyers. Under my leadership, the Bar continued its activism and activities by presenting over 200 programs and events and regularly voicing its support for civil rights and the Rule of Law. Recently, I become a member of the Executive Council of the National Conference of Bar Presidents and help to lead, educate and inspire state, local and specialty bar leaders at biannual meetings.

REPRESENTATIVE EMPLOYMENT MATTERS - Obtained a favorable settlement for an apparel company accused of disability discrimination. - Performed an internal audit of wage and hour policies and practices for an emerging I.T. company. - Favorably settled several sexual discrimination and harassment cases including a complex sexual harassment claim against an internationally-known entertainer. - Conducted an internal investigation of claims that an entertainment company executive had procured contracts by bribes. Advised company in termination of executive. - I recently tried a claim involving millions of dollars in damages for a client claiming to be owed royalties in connection with an oral sales agreement. - I am currently handling a complex fraud and breach of contract claim concerning a failed real estate partnership. - Representing former CEO in a sexual harassment and retaliation claim against the owner of the company she worked for. The matter is pending. REPRESENTATIVE BUSINESS LITIGATION MATTERS - I was the lead attorney defending a malpractice, fraud and conflict of interest claim against multi-state law firm and its partner. I created a successful law and motion strategy and negotiated a favorable settlement – including obtaining a letter confirming that my client did not have a conflict of interest. - I was one of the lead attorneys defending one of the world’s largest financial institutions from plaintiffs who brought securities fraud claims seeking in excess of $100 million. - While representing a federal employee in a constitutional tort claim, I obtained certiorari in the U.S. Supreme Court and, thereafter, the dismissal of my client from the case. See Hui v. Castaneda, (U.S. Supreme Court Case No. 08-1529).

OVERVIEW Worked in the Civil Division. I handled a variety of cases primarily defending the United States and federal employees. I handled numerous employment discrimination and environmental matters. I also brought affirmative actions for civil penalties. Below are several representative matters. REPRESENTATIVE MATTERS - Credit union examiner claimed discrimination on the basis of race, gender and national origin when she was denied a promotion. Thereafter, the examiner went on disability leave and was terminated. She claimed the termination was a result of race, gender, national origin, disability and retaliation discrimination. Obtained a defense verdict on all claims after two week bench trial. - Letter carrier claimed his termination was a result of racial and national origin discrimination. Successfully brought a motion for judgment following plaintiff’s presentation of evidence at trial. - Obtained summary judgment on former civilian Naval employee’s claim that termination following probationary period was a result of race and gender discrimination. - INS employee claimed that her year-long affair with high ranking official was harassment and, thereafter, she was terminated in retaliation for ending the affair. Court granted summary judgment on both claims. - Foundation for Horses and Other Animals v. Babbitt, 995 F. Supp. 1088 (C.D. Cal.), aff’d on other grounds, 154 F.3d 1103 (9th Cir. 1998). Court granted summary judgment finding that National Park Service’s review of plan to remove horses from Channel Islands National Park complied with National Environmental Policy Act. Case was affirmed by Ninth Circuit.
