Brian P. Kelly is an associate in the Washington, DC office of BuckleySandler LLP. Mr. Kelly has a broad range of experience representing corporate and individual clients in litigation and enforcement matters, including criminal and complex civil litigation, internal investigations, government enforcement actions, domestic and foreign forfeiture proceedings, and appellate matters. Those matters have involved civil and criminal RICO, mail and wire fraud, securities fraud, money laundering, gaming regulations, and SEC and DOJ investigations. In 2009, Mr. Kelly assisted in the successful appeal in the United States Supreme Court barring further prosecution of a former Enron executive on double jeopardy grounds. Yeager v. United States, 129 S. Ct. 2360 (2009). Prior to joining BuckleySandler, Mr. Kelly was an associate in the Government Enforcement Practice Group at Ropes & Gray. Mr. Kelly received his J.D. from The University of Chicago Law School in 2007 (with honors). He received a B.A. from Saint Louis University in 2004 (magna cum laude).

I was an associate in the Government Enforcement / White Collar practice group at Ropes & Gray LLP where I represented clients in trial and appellate litigation. I assisted in the successful appeal to the United States Supreme Court to bar the further federal insider trading and money laundering prosecution of a former Enron executive on double jeopardy grounds. Yeager v. United States, 129 S. Ct. 2360 (2009). I also represented Mr. Yeager in his related civil action and subsequent settlement with the SEC.

My recent work includes: -Was a lead attorney on the team that achieved a $554 million landmark breach of trust settlement on behalf of the Navajo Nation. The settlement is the largest ever obtained in an action by a Native American tribe against the United States. The team was selected as a 2015 finalist for the Public Justice Trial Lawyer of the Year Award. -Represented an international energy company in the investigation and prosecution by an independent United Nations body and foreign prosecutors for bribery and corruption involving foreign public officials. -Represented employees of a top European bank in DOJ and related internal investigations into FX market manipulation, and in the related NYDFS investigation into FX electronic trading and sales practices. -Represented actor Wesley Snipes in his appeal to the United States Supreme Court from a federal tax evasion prosecution. -Represented defendant attorney in a federal mail, wire, and honest services fraud prosecution and appeal related to a $34 million settlement for silica-related injuries.
